The Labour Court is set to deliver judgement over the matter relating to the Police and Prisons Civil Rights Union (POPCRU) and the Department of Correctional Services (DCS).

In our last appearance last week, the DCS raised a point of limine. Their argument is that the labour court does not have jurisdiction to hear a matter that relates to the Occupation, Health and Safety Act, and they argue that the court that has jurisdiction is the Magistrate’s court.

Our argument is that the matter relates to the employer forcing employees to work under an unsafe environment, and further threatening these employees with dismissal is they do not comply.

The court will be delivering a judgement on this point tomorrow.

If the court finds that it has jurisdiction, the merits will be heard on Thursday, 11 October 2018.

The judgement will take place as follows;

Monday, 8 October 2018

Labour Court, Braamfontein

Issued by POPCRU on 07/10/2018
