The Labour court will tomorrow be handing over judgement on the matter between the Police and Prisons Civil Rights Union (POPCRU) and the Department of Correctional Services (DCS).

The DCS had raised a point of limine, with their argument being that the labour court did not have jurisdiction to hear a matter that relates to the Occupation, Health and Safety Act, and they argued that the court that has jurisdiction is the Magistrate’s court.

Our argument was that the matter related to the employer forcing employees to work under unsafe environment, and further threatening these employees with dismissal if they did not comply.

The court will be delivering a judgement on this point as follows;

Friday, 12 October 2018

Labour Court, Braamfontein

Issued by POPCRU on 11/10/2018
