FUNCTIONS:

Legal Department is one of the Departments at POPCRU mainly responsible for retention of membership in line with the strategic objective of the organization. We are responsible for the enforcement of Compliance with Labour Legislation and collective agreements. Attend to union member’s complaints and grievances and management of representation of union members in disciplinary and arbitration hearings. Initiate and defend POPCRU and its members in Labour litigation, provide legal opinions to the union members and the shop stewards, monitor the training for union representatives on labour relations and Labour related issues. Monitor and manage the effective and efficient running of cases in all provinces, enhancing the website with updates of new developments in labour legislations and cases, development of the legal library nationally and translate it to the provinces. The Processing of Memos for formal requests of payments that are being directed to the National Office from the Provincial Offices relating to work executed within the respective Departments. The Processing of Memos for the Payment of finalized cases and traveling claims. Attending to Members’ enquiries and queries pertaining to their cases to ensure service delivery.

Functions of the Departmental Staff

HEAD OF DEPARTMENT – RODNEY RAMAFALO (011) 242- 4012

Head of Department is the central force of management within the department and plays the essential strategic role in retention of membership, Develop and Implement a Legal Support Services Strategy and Operational Plan in support of POPCRU Strategic Plan, Develop Policies, Procedures and Systems supportive of the implementation of the Strategic Plan,Customer Satisfaction Management ensuring POPCRU is compliant with SA legal framework, Manage process of labour litigation in support of members,manage Litigation Process for POPCRU and Shop Stewards at both National and Provincial Level, Quality and Risk Management on services offered by POPCRU to members, Vet and draft Contract and Service Level Agreement on behalf of POPCRU, manage Departmental Performance and People Management, Cross Functional Services- Provide Legal Advise and Support to other Departments within POPCRU (bargaining, organizing, Secretariat & Finance),manage Departmental Budget and Resources, Monitor effectiveness of training offered to Shop stewards

ADMINISTRATIVE SUPPORT – NTANDOYENKOSI MASILELA (011) 242-4640

The Administrative support is the link to all departmental staff members and is responsible for the administration within the department, specifically the everyday office tasks. The administrative support is also responsible for providing all the administrative support to the department, co-coordinating meetings for the department and, preparation of payment for finalized cases, Attorneys and traveling claims. Another central but focal role that the administrator plays is the Attorneys liaison for the department.

LABOUR RELATIONS OFFICER – NYAMAYAVHO NTIMANE (011) 242 -4648

The Labour Relations Officer is primarily responsible for Managing Employer- Employee Relations Services  within POPCRU, Provides legal advisory service to members of POPCRU, represent members in Disciplinary and Grievance hearings at employer level, monitors and enforces implementation of internal Resolutions and arbitration awards, monitors Customer Satisfaction Levels ,Co-ordinates Shop Stewards training in conjunction with Education and Training Unit also a Member of the Bargaining Council Committee and Dispute Resolution Committee .

LEGAL ADVISOR – TIMOTHY MAGWAZA (011) 242- 4613

Providing legal advice and opinions to Provinces and National Office on Employee Relations and Labour Law matters affecting POPCRU members, provide legal advice and opinion to Bargaining Council on matters of council, advise and support bargaining unit on review of collective agreement, policies and employments contracts of POPCRU members, represent POPCRU Members in complicated disciplinary and arbitration cases at the sectors where we operate. Ensure all employers where POPCRU enjoys membership comply with labour legislation (current and new) manage and Coordinate referrals and services offered to POPCRU member in relation to their cases during Litigation, administrate payments to service providers, implement and comply to governance principles and systems within Unit and POPCRU.
